if i can be any help, i will. i told my sister and this is what she had to say about it all.


Message from my sister who works in motor insurance

Hello! from my point of you I would hold the third party fully at fault for the accident. (and there is case law to support you, your insurers can get that- generally unless there is any witness evidence to the contrary, you would win if this went to court, though if your insurers are any good it wont come to this) As you were on the main road you have right of way and it was her responsibility to ensure the way was clear before she pulled out (even if she was inching out).
Although I cant see the junction she came out of in your photos it seems as if she would not have a had a very good view of your approach anyway and she may use this as an excuse (its not) and claim you may have been speeding- you may have not been but because she could not see you approach it may have seemed fast to her. if you were speeding and she can prove it then you may find it would have to be a slight split but mostly in your favour as the onus of responsibility lies with her.

The best thing you can do is write a detailed description and diagram of the accident detailing exactly how the accident happened and send it along with any photos you have to your insurance company as "evidence" they will probably send it to the other insurance company to prove her negligence. hope that helps! bye!

Thanks guys, my insurance told me the same thing - that as she was the one that was interupting a flow of traffic, it should be her fault. I know there's not much visibility around that bend but she didn't even inch out like most people would. I actually saw her stationary before she pulled out quite fast.

Massive thanks for your sisters advice Dai, very thoughtful of you mate - it's reasurring with a professionals opinion of it :). I'm glad I took photos now. I'm justing waiting for the insurance to find her liable, fingers crossed it doesn't take too long.

I've made it my mission to get it all repaired and ready for JAE no matter what the cost. If I fail I'll be seriously gutted...

I've bought some more mods to go on too, to cheer me up lol. It should look a little different from before when I'm finished...
